Abstract: „In this contribution, the authors examine the spatiotemporal distribution of residential burglaries in a Belgian police zone based on monthly residential burglaries before and during the COVID-19 crisis and assess the performance of a predictive crime model during this period. In general, compared to 2019, there were fewer home burglaries in 2020 during the COVID-19 crisis. Except for a few changes, the spatial distribution of residential burglaries in 2020 is largely similar to that of residential burglaries in 2019. The authors observe that the predictive crime model performs significantly worse at the start of the pandemic and when severe measures are taken, but that the model’s performance then rises again after a few months as the algorithm becomes more proficient in adjusting itself to big societal changes.“

Abstract: „Wereldwijd bestaan er zorgen dat de COVID-19-maatregelen hebben geleid tot een toename van huiselijk geweld. In deze studie kijken we naar de huiselijk geweldadviezen die door alle 26 Veilig Thuis-regio’s in Nederland zijn geregistreerd. Om te onderzoeken of er verschillen zijn in de geregistreerde omvang, vermoedelijke aard en type adviesvrager van huiselijk geweldadviezen voor, tijdens en na de invoering van de COVID-19-maatregelen vergelijken we data van 2019 met 2020 en 2021. De bevindingen laten een algehele toename van adviesvragen in 2020 en 2021 zien, die niet eenduidig kan worden toegeschreven aan de COVID-19-maatregelen. There have been worldwide concerns that the COVID-19 restrictions have led to an increase in domestic violence. In this study the authors examine the domestic violence advices that have been registered by all 26 Veilig Thuis (Safe Home) regions in the Netherlands. To study potential differences in prevalence, suspected nature and the type of person that seeks advice on domestic violence prior and during the COVID-19 pandemic, the authors compare data from 2019 with 2020 and 2021. The findings show a general increase in advices in 2020 and 2021, that cannot be unambiguously attributed to the COVID-19 restrictions.“

Abstract: „In this article, the author reflects on the impact of COVID-19 on policing, the relations among police officers and the interactions between police and citizens based on systematic social observations in small to semi-sized local police forces during the pandemic. The article discusses the nature of police work during the crisis and new types of interventions that police officers are confronted with (e.g. curfew controls). Additionally, the impact of the pandemic on the internal and external relations is discussed. Internally, the COVID-19 measures may have an impact on police officers’ possibilities for personal, social interactions among colleagues, which may potentially challenge the solidarity within the police force. Externally, tensions may arise in relations with citizens, partly because of unclear regulations or variable interpretations of those regulations. Those unclear regulations, but also uncertainties concerning one’s own competences and questions regarding the police’s role in enforcing the pandemic regulations, put pressure on the police’s (self-)legitimacy.“

Abstract: „In the second half of the last century, the position of detainees in the Netherlands improved considerably. As far as is possible in the case of persons deprived of their freedom, there has been a certain emancipation of detainees. A well-functioning right of complaint and appeal has been created, for example, that offers detainees the possibility to have decisions of the government, in particular those of the director of the institution and the selection official, that are unfavourable to them, reviewed by an independent judicial authority. Their living conditions have also improved during this period. However, in recent years there has also been a tendency for the government to make ever greater demands on the behaviour of detainees, in return for fewer opportunities for activities and freedoms aimed at resocialisation. Since last year, the corona pandemic and the way in which it is dealt with in prisons have put further pressure on the already vulnerable position of detainees. Since March 2020, prisoners have had their opportunities for phasing in and resocialising further reduced by the virtual prohibition of leave. Furthermore, the visiting possibilities and the activity programmes within the penitentiary institutions have been minimal for over a year.“

Aus dem Inhaltstext: „En 1993, la Commission européenne présentait le télétravail comme l’un des huit développements stratégiques pour lesquels il fallait stimuler les investissements. 27 ans plus tard, un virus d’une dimension de 2/100 d’un micron provoque en moins de trois mois un séisme économique et social mondial et un bouleversement dans nos organisations de travail. Le mot est jeté en pâture. « Télétravail ». Façonné, maçonné, désarticulé, défiguré, critiqué, exploité, instrumentalisé et médiatisé, il est devenu la star. Mais étions-nous vraiment en présence de « télétravail » ? Nous sommes passés de la vague silencieuse à la vague de Nazaré. Retournerons-nous à la normale ou nous dirigeons-nous vers l’anormal ? Cet ouvrage prépare les lecteurs, les entreprises et les professionnels des RH à cette mutation. Il rappelle les principales étapes du développement du télétravail à domicile ; aborde les réglementations internationales, européennes et nationales, la mise en œuvre du télétravail, les fonctions et travailleurs concernés ; confronte dans une approche transversale différentes thématiques que sont la durée du temps de travail, la sécurité et la santé des travailleurs, la protection des données et la vie privée ; traite des enjeux fiscaux, de sécurité sociale et de droit du travail liés aux nouvelles technologies mises à disposition des télétravailleurs. Dans le cadre de la crise sanitaire, il remet au goût du jour la réglementation PC privé. Il s’intéresse à la question de la responsabilité de l’employeur face aux risques de délocaliser l’utilisation des nouvelles technologies et anticipe des problématiques : la place du domicile privé, le présentéisme virtuel, la mobilité internationale et le télétravail face au COVID-19. Abstract: „La gestion politico-juridique de la pandémie de Covid-19 et de ses conséquences suscite de nombreuses questions, notamment dans le domaine du droit public. Les mesures adoptées respectent-elles la répartition des compétences entre autorité fédérale, communautés et régions? Le recours massif aux pouvoirs spéciaux et aux pouvoirs de police est-il compatible avec les principes consacrés par la Constitution et le droit international? Les restrictions considérables apportées aux droits fondamentaux pour limiter la propagation de la pandémie sont-elles excessives? Quel est le rôle des experts dans la prise des décisions? Ces questions, parmi d’autres, sont abordées dans le présent ouvrage au travers de 26 contributions thématiques réparties en trois parties. La première porte sur l’organisation des pouvoirs telle qu’elle a été bousculée par la crise. La deuxième concerne les instruments et les ressources de l’action publique et les adaptations que celle-ci a dû subir du fait de la pandémie. La troisième se focalise sur les droits fondamentaux. Près de soixante chercheurs issus de la plupart des universités belges ont contribué à l’ouvrage. Celui-ci s’adresse tant aux universitaires qui y trouveront des développements scientifiques riches et variés sur le sujet étudié, qu’à tous ceux – décideurs politiques ou membres du grand public – qui cherchent à comprendre les ressorts juridiques de la réponse de la Belgique à la pandémie de Covid-19 et les enjeux que cette réponse soulève sous l’angle du droit public.“

Abstract: „Ce cahier est le résultat d’une étude menée sur plusieurs années au sein du réseau de la STIB (Société des transports intercommunaux de Bruxelles). Divisé en deux parties, le Cahier présente les résultats de l’étude ainsi que les enseignements qui ressortent de ce Diagnostic de Sûreté. Dans la seconde partie, les auteurs s’attachent à dépeindre l’impact de la crise Covid-19 sur le niveau de sûreté au sein du réseau de la STIB. Une attention particulière est apportée sur l’influence de la baisse de fréquentation.“

Abstract: „[fr] Depuis quelques semaines, l’actualité nationale et internationale est dominée par un seul sujet : la Belgique, comme une large partie du monde, est touchée par la pandémie de la maladie infectieuse appelée Covid-19 qui est due à la propagation d’un coronavirus. Dans ce contexte extraordinaire, des mesures fortes ont été prises par les différentes autorités qui composent la structure fédérale belge. Le présent Courrier hebdomadaire entend livrer de premières observations juridiques sur la manière dont l’État belge, avec ses spécificités institutionnelles, a commencé à réagir à cette situation hors du commun. Il couvre la période du 12 mars au 30 mars, lors de laquelle la Belgique a progressivement vu s’établir un régime d’exception inédit en temps de paix. La contribution est articulée autour de quatre constats. En premier lieu, l’État belge a pris des mesures fortes, qui répondent à son obligation juridique de réagir face à un risque pour la vie. En second lieu, apporter une réponse centralisée à la crise sanitaire liée à l’épidémie de Covid-19 est, en Belgique, compliqué par le partage de compétences en vigueur entre les différents niveaux de pouvoir. En troisième lieu, la réponse à la crise du Covid-19 s’est traduite par des évolutions considérables dans les rapports entre les assemblées législatives et les pouvoirs exécutifs. En particulier, cette crise a eu pour effet de mettre un terme au régime d’affaires courantes au niveau fédéral. A presque tous les niveau de pouvoir, elle a également conduit à l’attribution, par les Parlements, de pouvoirs spéciaux à leurs gouvernements. Enfin, la crise sanitaire du Covid-19 a amené les pouvoirs publics belges à limiter les droits et libertés des citoyens d’une manière considérable. In deze buitengewone context hebben de verschillende overheden die deel uitmaken van de Belgische federale structuur krachtige maatregelen genomen. Deze "Courrier hebdomadaire" is bedoeld om enkele eerste juridische opmerkingen te maken over de manier waarop de Belgische staat, met zijn institutionele bijzonderheden, is begonnen te reageren op deze buitengewone situatie. Het bestrijkt de periode van 12 maart tot 30 maart, waarin in België geleidelijk aan een ongekend noodregime in vredestijd tot stand is gekomen. De bijdrage is gebaseerd op vier observaties. Ten eerste heeft de Belgische staat krachtige maatregelen genomen om te voldoen aan zijn wettelijke verplichting om te reageren op een risico voor het leven. Ten tweede wordt het geven van een gecentraliseerd antwoord op de gezondheidscrisis in verband met de Covid-19-epidemie in België bemoeilijkt door de bestaande bevoegdheidsverdeling tussen de verschillende bestuursniveaus. Ten derde heeft de reactie op de Covid-19-crisis geleid tot aanzienlijke veranderingen in de relatie tussen de wetgevende vergaderingen en de uitvoerende machten. Deze crisis heeft met name tot gevolg gehad dat er een einde is gekomen aan de ontslagnemende regering op federaal niveau. Op bijna alle niveaus van het federaal België heeft het ook geleid tot de toewijzing van speciale bevoegdheden door de parlementen aan hun regeringen. Ten slotte heeft de gezondheidscrisis van Covid-19 de Belgische overheid ertoe gebracht de rechten en vrijheden van de burgers aanzienlijk te beperken. Dieser "Courrier hebdomadaire" soll erste rechtliche Anmerkungen dazu liefern, wie der belgische Staat mit seinen institutionellen Besonderheiten auf diese außergewöhnliche Situation zu reagieren begonnen hat. Es umfasst den Zeitraum vom 12. März bis zum 30. März, in dem in Belgien nach und nach ein für Friedenszeiten beispielloses Notstandsregime eingeführt wurde. Der Beitrag basiert auf vier Beobachtungen. Erstens hat der belgische Staat strenge Maßnahmen ergriffen, die seiner gesetzlichen Verpflichtung entsprechen, auf eine Gefährdung von Leben zu reagieren. Zweitens wird die Bereitstellung einer zentralisierten Antwort auf die Gesundheitskrise im Zusammenhang mit der Covid-19-Epidemie in Belgien durch die bestehende Aufteilung der Kompetenzen zwischen den verschiedenen Regierungsebenen erschwert. Drittens hat die Reaktion auf die Covid-19-Krise zu erheblichen Veränderungen im Verhältnis zwischen den gesetzgebenden Versammlungen und der Exekutive geführt. Diese Krise hat insbesondere dazu geführt, dass das System des Tagesgeschäfts auf föderaler Ebene beendet wurde. Auf fast allen Machtebenen hat sie auch dazu geführt, dass die Parlamente ihren Regierungen Sonderbefugnisse zugewiesen haben. [en] For the past few weeks, national and international news has been dominated by a single subject: Belgium, like a large part of the world, is affected by the pandemic of the infectious disease called Covid-19, which is due to the spread of a coronavirus. In this extraordinary context, strong measures have been taken by the different authorities that make up the Belgian federal structure. This "Courrier hebdomadaire" intends to provide some initial legal observations on the way the Belgian State, with its institutional specificities, has begun to react to this extraordinary situation. It covers the period from 12 March to 30 March, during which Belgium gradually saw the establishment of an unprecedented peacetime emergency regime. The contribution is based on four observations. Firstly, the Belgian State has taken strong measures that meet its legal obligation to react to a risk to life of the Belgian citizens. Secondly, providing a centralised response to the health crisis linked to the Covid-19 pandemic is, in Belgium, complicated because of the existing division of competences between the different levels of government. Thirdly, the response to the Covid-19 crisis has led to considerable changes in the relationship between the legislative assemblies and the executive powers. In particular, this crisis has had the effect of putting an end to the system of the transitory government at the federal level. At almost all levels of power, it has also led to the allocation of special powers by parliaments to their governments. Finally, the Covid-19 health crisis led the Belgian public authorities to limit the rights and freedoms of citizens considerably.“

Abstract: „The current societal turbulences impose special requirements on policing. This essay suggests how to recalibrate Dutch policing, taking into account the views held in society and within the government about good police work and in view of the changed social need for policing. It is argued that that need has split into three: policing to protect bodies and property, to deal with disturbances in the functioning of society and government and to care for the living environment of citizens. It is argued how the organization of the National Police should respond to this threefold need.“

Abstract: „Dit artikel onderzoekt het Nederlandse politieke en media discours als reactie op de eerste golf van de wereldwijde covid-19-pandemie. Hierbij staat de vraag centraal in hoeverre de ontwikkeling en toon van dit discours de logica volgt van wat in de literatuur ook wel aangeduid wordt als ‘regeren door middel van migratiecontrole’. Volgens deze logica wordt migratie naar voren gebracht als een oorzaak van verschillende problematische, complexe, maatschappelijke ontwikkelingen, zelfs als er geen bewijs is om een dergelijk causaal verband te suggereren. Vanwege de veronderstelde relatie tussen migratie en het maatschappelijk probleem – in dit geval de covid-19 pandemie – wordt er een hardere toon in het discours rond migratie aangenomen, en kan dit zich zelf vertalen naar het nemen concrete maatregelen om de mobiliteit van mensen (verder) te beteugelen. Het artikel stelt vast dat, in deze eerste golf van de pandemie, deze specifieke dynamiek niet duidelijk aanwezig is in het Nederlandse politieke discours, noch in het mediadiscours.“

Abstract: „Het ‘grootste criminologische experiment in de geschiedenis’, zo noemden twee Amerikaanse criminologen de pandemie (Stickle & Felson 2020). En terecht. De sociale onthouding die overheden in vele landen hebben opgelegd als reactie op de coronapandemie, brengt interessante vragen en onderzoeksmogelijkheden met zich mee. Eén van die vragen is hoe criminaliteit zich ontwikkelt in tijden van gedwongen thuisblijven en afgenomen sociaal verkeer. Die vraag staat in dit artikel centraal. We gebruiken in onze analyses politiegegevens afkomstig uit de Corona Crime Change Monitor over twaalf ‘coronamaanden’ (medio maart 2020-medio maart 2021) en vergelijken de ontwikkeling van de criminaliteit in die periode met de ontwikkeling in dezelfde periode een jaar eerder. The social abstinence imposed by governments in many countries in response to the corona pandemic raises interesting questions and research opportunities. One of those questions is how crime develops in times of forced stay at home and reduced social interaction. That question is the focus of this article. In their analysis, the authors use police data from the Corona Crime Change Monitor for twelve ‘corona months’ (mid-March 2020-mid-March 2021) and compare the development of crime in that period with the development in the same period a year earlier.“

Abstract: „To control the COVID-19 outbreak Dutch government opted for a so-called intelligent lockdown. The virus as well as the lockdown caused significant personal and societal damage. It also created, however, a unique natural experiment. How did the forced stay in affect the crime levels? This article presents empirical data on crime trends during the lockdown. Initially, the general crime level decreased sharply. However, the general crime level quickly returned to pre-lockdown levels. Different types of crime displayed divergent trends, e.g. property crimes decreased sharply whereas online crime rates increased considerably. These trends fit rather well with an opportunity theoretical approach regarding crime.“

Abstract: „In de periode tussen 12 maart en 1 december 2020 hadden de 25 veiligheidsregio’s een sleutelrol bij de bestrijding van het coronavirus. Zij volgden de bindende aanwijzingen van de Minister van VWS op en hadden daarnaast de bevoegdheid om eigen maatregelen voor hun regio te nemen. Dankzij het afstemmingsoverleg tussen de veiligheidsregio’s in het Veiligheidsberaad is in de corona-aanpak niettemin steeds een grote mate van uniformiteit zichtbaar geweest. In deze bijdrage komt aan de orde hoe beperkt de ruimte voor een gedifferentieerde corona-aanpak in de afgelopen maanden is geweest en waarom de betrokkenheid van de veiligheidsregio’s bij de coronabestrijding achteraf gezien als een gelukkige greep kan worden beschouwd.“
